Terms of Service

1. Acceptance of Terms

By accessing or using Thermal Finance ("the Service"), operated by Vigilant Works, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age to use Thermal. By creating an account, you represent that you meet this requirement and that all information you provide is accurate.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription & Billing

  • Thermal offers paid subscription plans (Standard and Pro) with a 14-day free trial.
  • Payment is required to start a trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the applicable rate.
  • Subscriptions renew automatically at the end of each billing cycle unless canceled.
  • You may cancel your subscription at any time through the account settings page. Cancellation takes effect at the end of the current billing period — no prorated refunds are issued for partial periods.
  • Current plan pricing: Standard at $14.99/month ($120/year) and Pro at $29.99/month ($250/year).
  • Bank connection limits vary by plan: Standard supports up to 5 connected institutions and Pro supports up to 10.
  • We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
  • All payments are processed securely by Stripe. We do not store your full credit card number.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission.
  • Resell, sublicense, or commercially exploit the Service without authorization.

6. Not Financial Advice

Thermal is a financial planning and tracking tool. The information, projections, simulations, and AI-generated insights provided through the Service are for informational and educational purposes only and do not constitute financial, investment, tax, or legal advice. We are not a registered investment advisor, broker-dealer, or tax professional. You should consult a qualified professional before making financial decisions. We make no guarantees about the accuracy of projections or simulation results.

7. Intellectual Property

The Service, including its design, code, features, and content, is owned by Vigilant Works, LLC and protected by intellectual property laws. You retain ownership of your personal financial data. By using the Service, you grant us a limited license to use your data solely to provide and improve the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Vigilant Works, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or financial losses based on information provided by the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Vigilant Works, LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the account settings. Provisions that by their nature should survive termination (including limitation of liability and indemnification) will survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration under the rules of the American Arbitration Association. You agree that any proceedings shall be conducted on an individual basis and not as a class action.

13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice within the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
